Terms and Conditions

 
 

These terms apply to all The Photographic Adventure Company Ltd photography tours, adventures, weekends and events. Although we have to have these terms and conditions for operational purposes, The Photographic Adventure Company Ltd will always strive to resolve any issues or disputes before, during or after a booking.

A. All terms stated in these terms and conditions are enforceable under UK and Scottish Law and the participant accepts they have read, understood and abide by all conditions stated below in our terms and conditions. The Photographic Adventure Company Ltd reserves the right to amend and update these Terms and Conditions at it’s sole discretion without prior notice.

B. Customer Booking

  1. If you have made payment on The Photographic Adventure Company Ltd website you have agreed that you have read and understood these terms and conditions and therefore entered into contract with The Photographic Adventure Company Ltd for the chosen booking.

  2. Once a booking is received in the form of any payment whether a deposit or full payment amount and The Photographic Adventure Company Ltd confirms the booking, the reservation is therefore made and therefore bound by the terms set out in this agreement.

  3. Where more than one person is attending the event all participants need to read and agree to these terms and conditions. By proceeding with your booking and payment, you agree that all participants in the booking have read, understood and agreed to these terms.

  4. Our use of the term ‘all inclusive’ refers to everything that we deem necessary over the duration of the tour, adventure or event and whilst in the care of The Photographic Adventure Company Ltd. This includes but is not limited to: Hotels, transport during the tour, breakfast, dinner allowance as stated in each tour package, packed lunch on any full tour day. It does not include alcoholic drinks or personal purchases including refreshments outside of those provided by The Photographic Adventure Company Ltd. It does not refer to anything prior to the start time of the tour or adventure.

C. Fees and Payment for Tours and Adventures

  • Deposits are refundable at the discretion of The Photographic Adventure Company Ltd.

  • Full payment or any remaining balance of any tour or adventure booked is due 84 days (12 weeks) prior to the tour or adventure start date unless specifically agreed, in writing, by The Photographic Adventure Company Ltd or stated elsewhere.

  • If the tour or adventure is booked less than 84 days (12 weeks) in advance of the start date, then full payment will be payable at the time of booking, unless agreed otherwise in writing with The Photographic Adventure Company Ltd.

  • Any remaining balance not paid within 14 days of the tour or adventure start date will be deemed as a cancellation and The Photographic Adventure Company Ltd will treat it as such and no refund will be due, unless specifically agreed with The Photographic Adventure Company Ltd. The Photographic Adventure Company Ltd reserves the right to re-sell your reserved place on any tour or adventure in this instance.

  • The Photographic Adventure Company Ltd reserves the right to increase and/or decrease the tour or adventure costs at their own discretion.

D. Cancellations by you (the participant)

  • If you, the participant, cancel any tour or adventure that you have booked with The Photographic Adventure Company Ltd, you must do so in writing. All cancellation notices must be received by email and will be effective from the date of the email.

  • If you cancel any booked tour or adventure with more than 84 days (12 weeks) notice before the tour or adventure start date, your balance will not be payable, but you will forfeit your deposit, unless agreed otherwise with The Photographic Adventure Company Ltd. If you cancel your tour or adventure booking, having already paid the remaining balance of the tour or adventure cost, how much refund you are due will depend on the number of days prior to the tour or adventure start date the cancellation notice was received.

    As a guideline:

    1. 83 to 31 days before the start of the tour/adventure, cancellation fees are 50% of your balance.

    2. 30 days to 15 days before the start of the tour/adventure, cancellation fees are 90% of your balance.

    3. 14 days or less before the start of the tour/adventure, no refund will be given.

  • The option to transfer the remaining balance to another tour or adventure is not possible, except if agreed on a case by case basis with The Photographic Adventure Company Ltd. An additional admin fee may apply.

  • If you, the participant, do not attend the tour or adventure you have booked onto you will not be entitled to a transfer of booking(s) or a refund. Any transfer of booking and/or monies would be at the sole discretion of The Photographic Adventure Company Ltd and would be on a case by case basis.

E. Cancellations/Postponements by The Photographic Adventure Company Ltd (the provider)

  • The Photographic Adventure Company Ltd reserves the right to cancel or postpone any tour or adventure if it deems it appropriate to do so. Some of the reason(s) for cancellation or postponement could be due to severe weather, strikes, unforeseen illness, public disruption, travel services disruption or any other unforeseen circumstance that prevents the tour or adventure taking place on the planned date. In case of cancellation or postponement of this nature, alternative dates or a credit note will be offered.

  • If the minimum numbers are not booked to ensure the event is financial viable, The Photographic Adventure Company Ltd reserves the right to postpone and/or cancel any tour or adventure at any time and transfer the booking to an alternative date of the participants choosing. The chosen tour or adventure must be equal to or less than the initial tour or adventure booked by the participant.

  • The Photographic Adventure Company Ltd will not cancel any tour or adventure less than 30 days prior to the tour or adventure start date.

  • The Photographic Adventure Company Ltd cannot accept liability for any expense incurred resulting from cancellation. It is the responsibility of the participant to take out appropriate travel insurance protection to cover themselves against any potential costs incurred by unforeseen cancellation or postponement.

F. Insurance & Protection

  • It is the sole responsibility of you, the participant to take out appropriate travel insurance covering all personal belongings, theft, accidental damage, loss, injury, cancellation and any costs incurred resulting from any tour or adventure with The Photographic Adventure Company Ltd.

  • All participants take part on any tour or adventure at their own risk and The Photographic Adventure Company Ltd cannot accept any liability for loss or damage to themselves or their equipment.

  • It is a booking requirement that you, the participant accept the dangers involved in visiting remote and wild places. Participants of The Photographic Adventure Company Ltd tours and adventures should ensure that they have adequate insurance in place for the duration of the tour or adventure that they will be attending and for the activities undertaken. The insurance should cover cancellation, medical and emergency expenses, personal accident, injury and death.

  • It is the sole responsibility of you, the participant, to ensure all photographic equipment owned by you is fully insured and that the insurance is suitable for the activities being undertaken.

  • It is a booking requirement that all participants agree to adhere to any rules and guidelines laid out by either the tutor running the tour or adventure and/or by The Photographic Adventure Company Ltd themselves. Any participant not adhering does so at their own risk and expense. Neither the tutor nor The Photographic Adventure Company Ltd shall be liable for any person not adhering to the guidelines set out by The Photographic Adventure Company Ltd.

  • It is a booking requirement that all participants fill out the pre-booking forms on the website at time of booking, followed by any further forms sent out by The Photographic Adventure Company Ltd prior to attending the tour or adventure you, the participant is booked on.

  • The Photographic Adventure Company Ltd is a company committed to customer satisfaction and consumer

    financial protection. We are therefore pleased to announce that, at no extra cost to you, and in accordance with the

    current The Package Travel, Package Tours Regulations all passengers booking with The Photographic

    Adventure Company Ltd are fully insured for the initial deposit, and subsequently the balance of monies paid as

    detailed in your booking confirmation form. The policy will also include repatriation if required, arising from the

    cancellation or curtailment of your travel arrangements due to the insolvency of The Photographic Adventure

    Company Ltd.

    This Policy is issued by Evolution Insurance Company Limited which is registered in Gibraltar No. 88737 with a

    registered office at 5/5 Crutchett’s Ramp, Gibraltar, GX11 1AA.

    Evolution Insurance Company Limited is authorised and regulated by the Financial Services Commission in Gibraltar

    and authorised and subject to limited regulation by the Financial Conduct Authority (FCA) in the UK. Details about the

    extent of our authorisation and regulation by the FCA are available from us on request.

    In the unlikely event of Insolvency of The Photographic Adventure Company Ltd please follow the procedures

    below:

    Claims should be submitted in writing within 14 days of the Administration order or The Photographic

    Adventure Company Ltd being declared insolvent supported by documented evidence quantifying the value

    of the claim.

    Claims should be submitted to: Evolution Insurance Solutions Limited, 53A High Street, Saffron Walden,

    Essex, CB10 1AA or via email to claims@evo-insurance.com

    Policy exclusions: This policy will not cover any monies paid back to you by your Travel Insurance or any

    losses which are recoverable under another insurance or bond (with the exception of Credit and Debit card).

    This policy will also not cover any loss sustained by Passenger(s) booked on a flight-inclusive package sold

    and commencing within the United Kingdom.

  • The Photographic Adventure Company Ltd also has public liability insurance in place, appropriate for it’s business operating as a Tour Operator.

G. Personal Health and Safety

  • Whilst due care and diligence is taken by The Photographic Adventure Company Ltd to ensure the safety of all participants, it is the responsibility of all participants to ensure that they meet the fitness and health requirements before attending any tour or adventure. The nature of the business involves visiting wild and remote places and The Photographic Adventure Company Ltd cannot be held liable for any participant not abiding by the advice and guidelines set out. By completing a booking, you agree to follow all advice and guidelines set out by The Photographic Adventure Company Ltd. at all times.

  • It is the responsibility of the participant(s) to declare any medical conditions and any dietary requirements before attending the tour or adventure. Failure to do so may result in your place being terminated with no refund due.

H. Itinerary

  • The Photographic Adventure Company Ltd reserves the right to change and alter the itinerary for any tour or adventure if it deems it necessary to do so, especially if in the interest of safety for participants. This may be for a number of reasons, including but not limited to the forecast/weather, the group numbers, the health/fitness of group members, circumstances beyond the control of The Photographic Adventure Company Ltd.

I. Minimum Age of Participant

  • Any participant attending a tour or adventure run by The Photographic Adventure Company Ltd must be aged 18 or over at the time of the tour or adventure.

J. Accommodation, Meals, Travel and Additional Fees

  • Each tour or adventure page states what is included in your booking, such as hotels, meals, travel costs and any other chargeable items. It is the responsibility of the participant to ensure they have read and understood the likely additional costs in attending the tour or adventure, outside of the fees paid.

  • Non-participating partners/spouses are welcome to stay in the hotel accommodation for overnight tours or adventures but costs for their involvement are not included. If any participant wishes to bring their partners/spouses, then they should be notified at the time of booking the tour or adventure so that appropriate arrangements can be made. The Photographic Adventure Company Ltd reserves the right to decline partners/spouses if unable to make the necessary arrangements or the participant fails to inform The Photographic Adventure Company Ltd within the specified timescale mentioned above.

  • Any dietary requirements must be mentioned at time of booking, using the booking form at checkout. Failure to do so may result in inadequate arrangements.

These terms and conditions may seem strict and formal however The Photographic Adventure Company Ltd works hard to ensure that all participants receive a safe and enjoyable experience at all times. The Photographic Adventure Company Ltd has very high standards of service and will endeavour to make sure that all participants are respected and treated fairly at all times. We will also aim to resolve any disputes directly with the participant. These terms and conditions are outlined for the benefit of everyone attending a tour or adventure run by The Photographic Adventure Company Ltd.
